    Yes you could sue, however if the student can prove he, she, or they require special accommodation, your action may not be fruitful. I am regularly recorded without my consent. In one instance I confiscated a phone, and would not return it unless I witnessed the student delete the recording. Sometimes students record using their laptops. I can't confiscate a laptop because the nature of many of the courses I teach require use of the laptop during in-class demonstrations.

    It's a tough situation to be in sometimes. I know colleagues who have been recorded, and the recording then ends up online, but cleverly edited in order to mock and defame. This is why I would strongly advocate for all party consent. It is far too easy to edit audio and video for nefarious purposes and increasingly difficult to discern what is raw captured recording versus an edited recording. It's all good and well to say: "just don't say something you aren't prepared to own," but that's just not realistic in this day and age of AI generated deepfake porn etc.

                              • This link came across my Facebook feed yesterday. Not a MoSto guy but these letters are fascinating, and in the end pretty disturbing. I had never heard of Dr. Lowry Nelson but I have a lot of respect for him after reading these letters. Please note: this link takes you to photos of several letters from a collection at USU.
